1. Ownership of Content

All photographs, images, text, graphics, and media appearing on this website are the exclusive intellectual property of Michael Kloth Photography, unless otherwise noted. These materials are protected under United States Copyright Law (Title 17, U.S. Code) and applicable International Copyright laws and treaties.

As the copyright holder, I retain all rights, title, and interest in my creative work, including but not limited to the right to reproduce, distribute, display, and create derivative works.

2. All Rights Reserved

No part of this website or any of its contents—including photographs, text, graphics, logos, or other media—may be reproduced, copied, modified, distributed, transmitted, displayed, published, or adapted in any form or by any means without the prior written consent of Michael Kloth.

This protection applies to all uses, whether commercial or non-commercial, digital or print, public or private.

3. Prohibited Uses

The following actions are strictly prohibited without a formal, written license agreement:

  • Using images for AI training or machine learning datasets, including but not limited to generative AI models, image recognition systems, or any artificial intelligence application
  • Reposting to social media without explicit written permission and proper attribution
  • Reproducing in print or digital media including websites, blogs, publications, marketing materials, or presentations
  • Creating derivative works based on any images, including digital manipulations, collages, or compositions
  • Selling, licensing, or sublicensing any images to third parties

Unauthorized use constitutes copyright infringement and may result in legal action, including statutory damages, attorney's fees, and injunctive relief under applicable copyright law.

4. AI Training & Machine Learning Prohibition

I explicitly prohibit the use of any images, photographs, or visual content from this website for training artificial intelligence models, machine learning algorithms, or any automated image recognition or generation systems.

This prohibition includes but is not limited to:

  • Scraping images for dataset creation
  • Training generative AI image models
  • Computer vision training applications
  • Style transfer or image synthesis systems
  • Any automated or semi-automated image analysis or reproduction

Organizations, researchers, and developers are on notice that use of these images for AI/ML purposes without express written permission constitutes willful copyright infringement.

5. Commercial & Editorial Licensing

  • Specific commercial use rights if purchased (headshot clients, for example, receive commercial usage for professional purposes)

  • Clear parameters on modifications, reproductions, and distribution

  • Duration of license (perpetual for most portrait work)

If you are a current client and have questions about your specific scope of use, please refer to your License Agreement or contact me for clarification. I'm always happy to discuss expanded usage rights if your needs have changed since your original session.

7. Social Media & Web Sharing

Clients who have licensed images may share their portraits on personal social media accounts with the following attribution requirements:

  • Credit the photographer: Tag @michaelkloth or @tucsonpetphotography (for pet portraits) on Instagram, or include "Photography by Michael Kloth" in your caption

  • Do not crop out watermarks if present

  • Do not apply filters that substantially alter the image's color or composition

  • Do not use for commercial purposes beyond what's outlined in your license (personal social media is fine; using the image to sell products or services requires commercial licensing)

Non-clients may not share, repost, or republish any images from this website without prior written permission, even with attribution.

8. Print & Product Reproduction

Clients who wish to create prints, canvas reproductions, or photo products from their licensed digital images should note:

  • Personal prints for personal use are typically permitted under standard client licenses

  • Commercial reproduction (including selling prints, using images on merchandise, or mass production) requires explicit commercial licensing

  • Quality control: While you may print through any lab, I'm always available to provide recommendations for professional labs that will honor the color and quality of your images

If you're unsure whether your intended use falls within your license, please ask before proceeding. I'm here to help ensure you can use your images appropriately while protecting the integrity of the work.

9. Educational & Fair Use

Limited use of images for educational, commentary, or review purposes may qualify as fair use under U.S. Copyright Law. However, fair use is determined on a case-by-case basis and is not a blanket exemption.

If you wish to use images for educational purposes, academic research, or critical commentary, please contact me to discuss your project. In many cases, I'm happy to grant permission for legitimate educational use with proper attribution.

10. Copyright Infringement Reporting

If you become aware of unauthorized use of my images, I appreciate your assistance in protecting my intellectual property. Please report suspected infringement to mike@michaelklothphotography.com with the following information:

  • URL or location where the unauthorized use appears

  • Description of the image(s) being used

  • Any additional context that may be helpful

I take copyright infringement seriously and will pursue appropriate legal remedies when my work is used without authorization.

This Copyright & Licensing Notice is governed by the laws of the State of Arizona and applicable United States federal law. Any disputes arising from copyright infringement or licensing disagreements will be subject to the jurisdiction of courts in Pima County, Arizona.
